Welcome to the Into The Gnar app ("the App"). By accessing or using the App, you agree to the following Terms of Use ("Terms"). If you do not agree, do not use the App.

1. General Terms

• 1.1 The App is provided "as is" and may be updated or changed at any time.
• 1.2 Features may be added, modified, or removed as the platform evolves.
• 1.3 While we strive for accuracy, the App may contain errors or inaccuracies.
• 1.4 You understand that you are using the App at your own risk.

2. No Professional Advice / No Guarantees

• 2.1 The App includes tools related to mountain biking, backcountry skiing/snowboarding, and other action sports, including risk awareness, personal assessments, safety preparation, and professional networking.
• 2.2 All content is informational only and does not constitute professional, medical, psychological, nutritional, or safety advice.
• 2.3 Professionals listed in the Network (coaches, mechanics, guides, nutritionists, sports medicine professionals, mental performance coaches, etc.) are independent service providers. We do not verify their credentials, qualifications, or services.
• 2.4 You are solely responsible for your decisions, your riding, and your actions, including any services you engage through the App.
• 2.5 AI-Generated Content Disclaimer: The App includes in-app AI agents (YoB, Yoann OS, HPA Coach, Performance Coach, ITG Assistant) and AI-powered analysis features that generate insights, recommendations, coaching nudges, daily briefings, and conversational responses. All AI-generated content is produced by large language models and is informational only. AI responses may be inaccurate, incomplete, or inappropriate for your situation. AI agents are not coaches, medical professionals, or certified experts — their suggestions do not constitute professional advice and must not replace proper training, medical advice, or professional instruction. You are responsible for verifying the accuracy of any AI-generated content before acting on it.

3. User Responsibilities

You agree that you will:

• Use the App responsibly and honestly
• Not rely solely on the App for safety decisions
• Seek professional medical or coaching advice when needed
• Ride within your limits and follow all trail rules
• Conduct your own due diligence when engaging professionals through the Network
• Respect other users and maintain appropriate conduct in community features
• Not misrepresent your qualifications or credentials in professional profiles
• Honor commitments made through the Sales Hub, team applications, or camp inquiries

3.1 User-Generated Content & Community Guidelines

The App allows users to post content including text, photos, videos, and comments. By using these features, you agree:

• You will not post content that is offensive, abusive, threatening, defamatory, obscene, or otherwise objectionable.
• You will not harass, bully, intimidate, or threaten other users.
• You will not post content that promotes violence, discrimination, hate speech, or illegal activities.
• You will not post spam, misleading content, or impersonate others.
• You will not post sexually explicit or pornographic material.
• You are solely responsible for all content you create and share on the platform.

Content Moderation & Enforcement

• A reporting mechanism is available on all user-generated content to flag objectionable material.
• A blocking mechanism is available to block abusive users, which immediately removes their content from your feed and notifies our moderation team.
• All reported content will be reviewed and actioned within 24 hours.
• Content found to violate these guidelines will be removed, and the offending user may be suspended or permanently banned.
• We reserve the right to remove any content at our sole discretion without prior notice.
• Repeated violations will result in permanent account termination.

3.5 Professional Network Terms

If you create a professional profile (athlete, brand, coach, mechanic, guide, etc.):

• You represent that all information in your profile is accurate and truthful
• You are responsible for verifying your own credentials and certifications
• You agree to respond to inquiries in a professional and timely manner
• You understand that reviews and ratings from clients will be publicly visible
• You accept responsibility for any services you provide through connections made via the App
• Subscription fees may apply for professional features beyond free tier limits

3.6 Sales Hub Terms (B2B)

If you use Sales Hub features as a brand or dealer:

• All orders and transactions are between you and the other party directly
• Into The Gnar is not a party to any sales transactions and does not process payments
• Brands are responsible for fulfilling orders and honoring stated terms
• Dealers are responsible for payment according to agreed terms
• Disputes between brands and dealers must be resolved between those parties
• Subscription fees apply for Sales Hub features

3.7 Teams & Camps Terms

For team administrators and camp operators:

• You are responsible for accurately representing your team or camp
• Job postings must be legitimate opportunities
• Camp events and schedules must be accurately listed
• You are responsible for vetting applicants and participants
• Any employment or participation agreements are between you and the individual

4. Limitation of Liability

To the fullest extent permitted by law:

• The creators of the App, Barelli Concepts, contributors, developers, and partners are not liable for any injuries, damages, losses, accidents, or decisions arising from the use of this App.
• You release us from all claims related to your use of the App, including risks associated with riding, training, decision-making, assessment tools, communication features, or professional services engaged through the Network.
• We are not responsible for the actions, advice, services, or conduct of any professionals, brands, teams, or camps listed in the Network.
• We are not responsible for any business transactions conducted through the Sales Hub.
• We are not responsible for the accuracy of information provided by other users or professionals.

5. Data and Privacy

• 5.1 By using the App, you consent to the collection and processing of your data as outlined in the Privacy Policy.
• 5.2 You acknowledge that data may be stored, processed, or updated as the App evolves.
• 5.3 You may request deletion of your account and personal data at any time through the App's settings.

6. Changes to the App

We may modify, update, or remove features at any time. We will make reasonable efforts to notify users of significant changes.

7. Feedback and Contribution

If you submit feedback or suggestions, you grant Barelli Concepts a perpetual, royalty-free license to use, modify, and implement those suggestions.

8. Governing Law

These Terms are governed by the laws of British Columbia, Canada.

9. Intellectual Property

• 9.1 The App, its design, features, and content (excluding user-generated content) are owned by Barelli Concepts.
• 9.2 You retain ownership of content you create (posts, profiles, photos, etc.) but grant us a license to display and use it within the App.
• 9.3 You may not copy, modify, or redistribute the App or its features without permission.

10. Subscription & Payment Terms

• 10.1 Certain professional features require paid subscriptions (Professional Network tiers, Sales Hub plans).
• 10.2 Subscriptions are processed through Stripe. Payment terms are displayed at checkout.
• 10.3 Refund policies are determined on a case-by-case basis. Contact us for refund requests.
• 10.4 We reserve the right to change pricing with notice to existing subscribers.
• 10.5 Coaching sessions, camp registrations, and HPA coaching programs are paid services processed through Stripe. All fees are displayed at checkout. Refund requests are handled on a case-by-case basis — contact us at info@barelliconcepts.com.
• 10.6 HPA (High Performance Athlete) coaching programs are subscription-based. Credits for video analysis reset per billing cycle based on your tier. Unused credits do not roll over. Cancel anytime; access continues until the end of the current billing period.
• 10.7 Camp registrations include jersey orders and optional add-ons. Cancellations and refund eligibility depend on timing and are communicated at booking.
